Can You Sell Your AI Generated Images?

Short answer: Technically, yes.

Long answer: But is it ethical to sell them, given the constraints and debate surrounding AI and intellectual property rights? Here, things start to get a little murkier. Where does the work of an AI, and in this case, an image produced by it, fall within the spectrum of copyright law? More importantly, who’s the rightful owner of such images? Is it you as the user or the developer who created and coded that AI model?

What Are AI Generated Images?

Before we can discuss selling them, let’s clearly define AI generated images. In essence, they are pictures created by Artificial Intelligence through algorithms programmed to mimic specific styles or patterns and produce visual content such as people, scenery, or even space imagery that may not exist in reality.

The tools used range from free online AI image generators and random image generators to various anime AI generator apps available to users today.

How Does It Work?

Most AI image generators use a model called GANs (Generative Adversarial Networks). This consists of two parts: the generator, which creates images from noise, and the discriminator, whose job it is to distinguish if the created image is ‘real’ given training data or ‘fake’.

An AI, no matter how advanced, cannot be awarded ownership rights as it does not have consciousness or the ability to be uniquely creative.

Copyright Uncertainty: The U.S. Copyright Office has clarified that works produced solely by artificial intelligence are not eligible for copyright protection.

Potential Infringement: AI models are trained on existing images, raising concerns about copyright infringement. Several lawsuits have been filed against AI companies alleging unauthorized use of copyrighted works in training data.

Lack of Precedent: There is little legal precedent specifically addressing AI-generated art, making outcomes of potential lawsuits unpredictable.

Ethical Debates: Some argue that selling AI art devalues human artists’ work. Others view it as a new creative medium.

Transparency Requirements: Platforms like Getty Images now require disclosure when submitting AI-generated content for sale.
